Our terms and conditions apply to all transactions on the Quickdraw Supplies Ltd. website and are set out below. Please read through these carefully before placing your order and then print a copy for future reference. Please also read information regarding personal details provided by you relating to the Data Protection Act, in our Privacy Policy section.

We may change these terms from time to time without notice to you, changes will apply to any subsequent orders received.

Delivery charges and estimated timescales are specified in the Delivery Information section. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable.

We take payment from your card after we receive your order, once we have checked your card details. Goods are sold subject to availability, in the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.

The price you pay is the price displayed on this website at the time we receive your order with the following exception: Whilst we try to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Payment can be made by any method specified in the Delivery Information section. We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

The contract between us shall be governed by the laws of England and Wales and any dispute between us will be resolved exclusively in the courts of England and Wales. English is the only language offered for the conclusion of the contract.

Sometimes the product specifications from a manufacturer may change, in which case we will do our best to offer you a substitute of the same or better quality at the same price. Where applicable, you may cancel your order in accordance with your rights under the Distance Selling Regulations, see the Returns and Refunds page for further details. Quoted sizes, weights and measurements are approximate but we do try to make sure that they are as accurate as possible. On the rare occasion that there is an error, we will advise you about it as soon as possible.

We’ve selected our products for sale on the basis that they will be used for domestic use only, if you are planning to use them for business purposes please make sure that you are covered by appropriate insurance. All orders are accepted and goods supplied subject to the following express terms and conditions (the Company’s standard conditions of sale) and, save to the extent that the exclusion or restriction of liability may be prohibited by stature, all other conditions, warranties and representations, expressed or implied and statutory or otherwise, except as to title, are hereby excluded. Any order placed by a customer shall constitute an offer to contract upon these express terms and conditions, and no addition thereto or variation there from, whether contained in the customer’s order or otherwise shall apply unless expressly agreed in writing by the Company’s authorised representative.

2. DEFINITIONS
‘The Company’ means Quickdraw Supplies Ltd. ‘The customer’ means the person to whom the Company may agree to sell goods and in accordance with the Company’s standard conditions of sale. ‘The Goods’ means the articles or things or any of them or any part of them to be provided by the Company in accordance with the Company’s standard conditions of sale.

3. ORDERS
All orders are subject to availability of the goods and to written acceptance by the Company’s authorised representative. Any prior confirmation by the Company by telex or telephone shall be deemed to be provisional only.

4. PRICES
(a) Catalogues, price lists and other advertising literature or material as used by the Company are intended only as an indication to price and range of goods offered and no prices, descriptions or other particulars contained therein shall be binding on the Company.
(b) All quoted or listed prices are based on the cost to the Company of supplying the Goods to the customer and if before delivery of Goods there occurs any increase in any way of such costs in respect of Goods which have not yet been delivered the price payable shall be subject to amendment without notice at the Company’s discretion. Prices are inclusive of VAT at current rate.

5. MANUFACTURER SPECIFICATION
The Company will not be liable in respect of any loss or damage caused by or resulting from any variation for whatever reason in the Manufacturer’s specifications or technical data and will not be responsible for any loss or damage resulting from curtailment or cessation of supply following such variation. The Company will endeavour to advise the customer of any such impending variation as soon as it receives notice thereof from the Manufacturer.

6. CARRIAGE AND DELIVERY
Unless otherwise specifically agreed prices do not include delivery charges to the customer, and the Company reserves the right to levy a charge for delivery to any destination advised by the customer. Please note delivery of large items will be to ground floor level unless agreed prior to despatch.

7. PASSING OF RISK AND PROPERTY
(a) Risk in the Goods shall pass to the customer on delivery.
(b) Property of the Goods shall remain in the Company until payment in full therefore has been made by the customer.
(c) If payment in full is not made in accordance with the Company’s standard conditions of sale the Company may require the customer to return the Goods forthwith and if the requirement is not immediately complied with the Company shall be entitled at any time and without notice to retake possession of the whole or any part of the Goods (and for that purpose to enter the premises occupied by the customer and sever the Goods from anything they are attached to without being responsible for any damage thereby caused) without prejudice to any other remedy that may be available to the Company.

8. DEFECTS AND USE
Save as herein expressly provided, and save to the extent that the exclusion or restriction of liability may be prohibited by statute, the Company shall not be liable for any loss of whatsoever nature or to whomsoever or whatsoever caused arising out of the use of the Goods. The customer shall indemnify the Company against all claims made against the company by any third party in respect, thereof. Unless otherwise agreed.
(a) Where the Goods are rejected by the customer as not being in accordance with the customer’s order, the Company will only-accept the return of such Goods provided that it receives written notice thereof, giving detailed reasons for rejection, within 14 days of receipt of the Goods by the customer, and if such notice is not received by the Company within the said period of 14 days the Goods shall be deemed to have been accepted by the customer. The Company will not consider any claim for compensation, indemnity, or refund until liability if any has been established or agreed with the Manufacturer and where applicable the Insurance Company and under no circumstances shall be invoiced costs of the goods be deducted or set off by the customer until the Company has passed a corresponding credit note.
(b) In the case of defects or faulty workmanship in the Goods or any part thereof the customer shall not be entitled to receive any compensation, credit or refund in excess of that received by the Company under any guarantee or warranty given to it by the Manufacturer or the supplier thereof.

9. PAYMENT
Save as herein expressly provided, unless otherwise specifically negotiated and agreed, all accounts are payable prior to shipping of the goods.

INTEREST ON LATE PAYMENT:
(a) If the Customer shall fail to make payment when due the Customer shall additionally pay compound interest on all sums owing by it to the Company in respect of the Goods at the rate of four per cent above Barclays Bank Base Rate from the date that payment of those sums was due under these Conditions until payment thereof in full.

(b) This provision shall be without prejudice to any other legal rights or remedies available to the Company if the Customer shall fail to make payment when due.

10. DESPATCH
Any times quoted for despatch are to be treated as estimates only and without prejudice, although every endeavour will be made by the Company to adhere to them. Quotations or offers of goods ex-stock are subject to the goods being unsold at the time of receipt of the customer’s written order. All despatch dates are calculated from the date of acceptance of the customer’s written order or from the date when all outstanding technical details have been resolved which ever is the later.

11. CUSTOMER’S DEFAULT AND CANCELLATIONS AND RE-SCHEDULING OF DELIVERIES
(a) If the customer shall make default in or commit any breach of any of its obligations to the Company or if the customer being an individual (or when the customer is a firm, any partner in that firm) shall at any time become bankrupt or shall have a receiving order or administration order made against him or shall make any composition or arrangement with or for the benefit of his creditors or shall purport to do so if in Scotland he shall be made insolvent or bankrupt or any application shall be made under any Bankruptcy Act for the time being in force for sequestration of his estate or a Trust Deed shall be granted by him on behalf of his creditors or the customer being an incorporated body any resolution or petition to wind up its business shall be passed or presented otherwise than for reconstruction or amalgamation or if a liquidator or receiver or manager of such corporate body or its undertaking property or assets or any part thereof shall be appointed or if the customer shall be insolvent or shall be unable or shall admit its inability to meet its commitments promptly as and when due the Company shall have the right (without prejudice to any further or other claims or right which the Company might have) forthwith to cancel any uncomplicated order or to cancel or suspend delivery and, notwithstanding any other provisions of the Company’s standard conditions of sale, payments for any delivery already made shall immediately become due.

(b) Requests by a customer for cancellation of any order or for re-scheduling of deliveries will only be considered by the Company if made in writing, and shall be subject to the written acceptance of the Company in accordance with sub-clause 11 (a) as aforesaid, or if cancelled or re-scheduled at the request of a customer as aforesaid then the customer shall indemnify the Company against all loss, costs (including the cost of labour and materials used and overheads incurred), damages, charges and expenses arising out of the order and the cancellation or re-scheduling thereof.

12. FORCE MAJEURE
The Company shall not be liable for the cancellation of any order or any unfulfilled part thereof or for effecting partial delivery or performance if performance by the Company is prevented or delayed whether directly or indirectly by any cause whatsoever beyond the reasonable control of the Company whether such cause existed or was foreseeable at the date of acceptance of the customer’s order by the Company or not and without prejudice to the generalities of the foregoing any cause shall be deemed to prevent, hinder or delay the Company if the Company is thereby prevented, hindered or delayed from fulfilling other similar commitments whether to the customer or to third parties.

13. NON STANDARD GOODS
Unless otherwise agreed the Goods are supplied in accordance with the Manufacturer’s standard specifications. The Company reserves the right to increase its quoted or listed price or to charge accordingly in respect of any orders accepted for products of non-standard specification and in no circumstances will it consider ca ncellation of such orders or the return of the Goods.

14. SEVERABILITY
If and to the extent that any provision or any part of a provision of the Company’s standard conditions of sale is illegal, void or unenforceable for any reason, then such provision or part thereof (as the case may be) shall be deemed to b e severable from the remaining in provisions or parts of the relevant provision (as the case may be) all of which remaining provisions shall remain in full force and effect.

15. WAIVER
The waiver by the Company of any breach of any term hereunder shall not prevent the subsequent enforcement of that term, and shall not be deemed a waiver of any subsequent breach.

16. SOFTWARE
(a) All software, including related documentation, is supplied under license of the applicable proprietary owner.
TITLE OR OWNERSHIP TO SOFTWARE DOES NOT TRANSFER TO THE CUSTOMER UNDER ANY CIRCUMSTANCES

(b) It is the sole responsibility of the customer to comply with any terms and conditions of license attaching to software supplied and delivered by the Company and the customer is hereby notified that failure to comply with such terms and conditions could result in the customer being refused a software license or having the same revoked by the proprietary owner.

(c) All software delivered hereunder is supplied ‘as is’ and the sole obligation of the Company in connection with the supply of software is to obtain and supply a corrected version from the manufacturer concerned in the event such software fails to conform to its product description or proves in any other way to be defective PROVIDED ALWAYS that the customer notifies the Company of any defect or non-conformance to product description within Customer agrees not to assign or transfer the Agreement or any of its rights herein without the prior written consent of the service provider.

17. ASSIGNMENT
Customer agrees to assign or transfer the Agreement or any of its rights herein without prior written consent of the Company.

CONSUMER CONTRACT – TERMS AND CONDITIONS

The contract to supply goods by Quickdraw Supplies Ltd. each customer will be made when Quickdraw debits the account of the customer. Quickdraw Supplies Ltd. will e-mail or write to, the customer confirming the order made.

Quickdraw will not ship to a PO Box address. Where possible, accepted orders will normally be delivered
within 3-5 working days and customers will be informed of any delays. We also offer a 24 and 48 hour delivery service for orders received by 1.00 p.m. on a normal working day.

Customers have the right to cancel the contract by giving notice in writing to Quickdraw (for example by letter, fax, or e-mail). The period in which the customer may cancel the contract lasts from the day of the sev enth working day from the day after the customer receives the goods. Quickdraw will only accept such cancel lation where the customer has taken reasonable care of the goods and has not opened their protective
packaging.

In the event that the customer cancels the contract the customer will return the goods to Quickdraw at the address stated below within fourteen days. The customer will be responsible for returned postage costs. When returning goods the customer should ensure that they are sent in a suitable packaging which is correctly ad dressed and bears adequate postage and that details of the customer and the invoice number are enclosed to enable the transaction to be easily identifiable by Quickdraw. In the event that the customer fails to return the goods in the above manner within a fourteen day period Quickdraw will arrange for the collection of the goods by courier. The courier charges incurred by Quickdraw will be charged to the customer. In the event that it is necessary for Quickdraw to arrange for goods to be collected by courier Quickdraw will notify the customer 48 hours prior to collection of goods by courier of the date and the approximate time that the goods will be collected.

The contract price is the price displayed on the web site at the time the order is placed. This price will remain valid until the goods are supplied or until the order has been cancelled

BUSINESS USERS – TERMS AND CONDITIONS

If your product develops a fault within 30 days of purchase, we will exchange it for equivalent product if available, or if you prefer, refund your money. This does not apply to faults caused by accident, neglect or misuse of the goods. You must quote your invoice number in any correspondence & keep your receipt.

If you are unhappy about the quality of the item you have bought, you may return it to us within 30 days for a full refund of the cost of the goods less the initial cost of delivery. If you return it to us by post, unopened in its original condition, within 30 days, we will issue a full refund for the price of the item. If, within 30 days from the date you bought it, an item you have bought does not work properly, we may replace it. Before returning any goods a Returns number must be assigned to the goods. Please phone 02380 669628 or email support@qdsupplies.co.uk to receive this number before attempting to return any goods. Returns without the correct Returns Number shown will be rejected. Please return it to us by post (recorded delivery) or registered courier in a suitable postal box (not an envelope or jiffy bag) with a note saying what you think is wrong with it and a copy of the invoice. We will decide whether a product works properly against the specification set by its manufacturer. We will not replace products which do not work properly because they have been used or stored incorrectly or have been damaged after you bought them. You are responsible for getting goods back to us in good condition. Quickdraw will not be held responsible for damages caused to the cartridges caused during their return. All packages must be sent in a suitable packing box. Returns sent in envelopes or unsuitable packaging will be rejected.

Replacement of ‘faulty’ goods is not a guarantee or promise that all consumables will always meet the speci fication set by their manufacturer or that they won’t fail. We do not promise that the consumable you have bought will last for a particular length of time. How long a consumable will last will depend entirely on how much you use it.

The only terms to be included in the contract between us are those contained or referred to in this website. We do not offer or agree to any other conditions, warranties, guarantees or representations about the quality or description of the products we supply.

The guarantees exclude faults caused by accident, neglect or misuse of the goods. Where a manufacturer’s guarantee is offered with any product it is additional to this guarantee.

Goods other than faulty goods may be returned within 14 UK working days of the date of delivery if their packaging is in new condition and the goods that do not comply with this may not be returned. be issued. This number must be quoted on all correspondence and must be clearly shown on the outside of the returned package. All returns must be sent via Registered or Recorded Mail or by Registered Courier. Returns of goods other than for reasons of fault will be subject to a standard charge to cover postage and packaging which will be £2.99 for UK Deliveries and £6.99 for non-UK Deliveries. The warranty period begins when the product is purchased by the user (invoice date). The warranty is not a guarantee or promise that your product will conform to its specification or will not fail.

Damaged In Transit Supplies

If you receive a package that has been damaged due to shipping, you must notify the carrier and quickdrawsupplies.com immediately.

Clearance and Refurbished Items

Clearance items CANNOT be returned unless Dead on Arrival (DOA).

Defective Supplies

Return of a defective product is accepted according to manufacturer return policies. All defective returns must be sent freight pre-paid within 30 days of original invoice. Malfunction caused by abuse or misuse does not qualify for return or replacement. Products which fail under warranty must be either returned directly to the manufacturer of the product (according to the terms of the manufacturer’s warranty), or re turned to Quickdrawsupplies.com.

Custom order supply products which fully meet the customer’s specifications will not be accepted for return/credit, unless they are damaged in shipment or are defective.

Cancellation Policy
In stock orders can not be cancelled.

Supply Return Requirements

Returned supplies and products must be in full unopened cartons and in good resalable condition, except for damaged or defective returns.
Customers must be able to provide proof of purchase (shipping document or invoice) if the purchase cannot be verified as having been made directly from quickdrawsupplies.com.

Supply return acceptance will be in accordance with this policy. Prices listed on this website are in British Pounds (£) and are inclusive of VAT. All brand names and Trademarks used here are for identification purposes only. These names and Trademarks belong to their registered owners.
